Agreement to Terms

By using Ask Nomi ("we," "us," "our"), you agree to these Terms of Service ("Terms").

IF YOU DON'T AGREE, DON'T USE OUR SERVICES.

1. Eligibility

You must be 18 years or older to use our Services.

By using our Services, you confirm that:

• You are at least 18 years old
• You can legally agree to these Terms
• All information you provide is accurate

2. Your Account

To use our Services, you create an account. You agree to:

• Provide accurate information
• Keep your password secure
• Not share your account
• Notify us of unauthorized use

You are responsible for all activity on your account.

3. Privacy

We care about your privacy. Please read our Privacy Policy to understand how we collect, use, and protect your data.

4. Medical Disclaimer

Our Services provide:

• Health tracking tools
• Informational content
• AI-powered insights for tracking purposes only

Our Services do NOT provide:

• Medical diagnosis or treatment
• Professional medical advice
• A replacement for healthcare providers

You must:

• Always consult qualified healthcare providers for medical decisions
• Not rely on our Services for medical emergencies
• Understand that AI may provide inaccurate information

If you have a medical emergency, call 911 immediately.

We are not responsible for any health outcomes resulting from use of our Services.

5. Group Support, Educational Programs, and Group Offerings

Ask Nomi may offer peer-support, educational, community, or group-based programs, including programs related to endometriosis, chronic pain, emotional wellbeing, relationships, care navigation, and related topics.

These programs are intended to provide education, reflection, peer connection, and general support. Unless we clearly state otherwise in writing, these programs are not therapy, psychotherapy, medical care, mental health treatment, or clinical care.

Participation in any Ask Nomi peer-support, educational, or group program does not create a therapist-client, doctor-patient, clinician-patient, or treatment relationship between you and Ask Nomi, any facilitator, guest speaker, provider, or other participant.

Any information shared during these programs is for general educational and peer-support purposes only. It should not be treated as medical, mental health, legal, or professional advice, and it should not replace care or advice from your own licensed healthcare providers.

You are responsible for deciding whether participation is appropriate for you. You are also responsible for seeking medical, mental health, or emergency support when needed.

By participating, you agree to respect the privacy of others. You agree not to record, screenshot, photograph, transcribe, post, publish, or share any part of the session, or any other participant's name, story, health information, or personal details.

The facilitator will maintain confidentiality consistent with applicable ethical and legal requirements. However, because this is a group setting, confidentiality cannot be absolutely guaranteed. Each participant agrees not to disclose identifying information about other group members or share what other members discuss.

Participants may share their own learning from the group, but should not share names, identifying details, personal stories, screenshots, recordings, or private information about other participants.

Limits of Confidentiality (important)

Confidentiality has legal and ethical limits. The facilitator may be required or permitted to disclose information in certain circumstances, including but not limited to:

Virtual Group Participation

If the group is held virtually, participants agree to:

Ask Nomi may remove any participant from a program if we believe their behavior is disruptive, unsafe, disrespectful, or inconsistent with the purpose or guidelines of the group.

6. Acceptable Use

You agree to use our Services responsibly and legally.

You will NOT:

• Violate any laws
• Harass or harm others
• Share false information
• Use bots or automated tools
• Try to hack or break our Services
• Share your account with others
• Misrepresent your age

We may suspend or terminate accounts that violate these rules.

7. Ownership

We own our Services, including:

• All software, code, and technology
• Design, graphics, and content
• Trademarks and branding

You own your data, including:

• Your health tracking information
• Your messages and content
• Files you upload

By using our Services, you give us permission to:

• Store and process your data to provide Services
• Use anonymized data to improve our products
• Display your data back to you

You can delete your data anytime.

8. Third-Party Services

Our Services may integrate with third-party apps like:

• Apple HealthKit
• Google Health Connect
• Wearable devices

When you use these integrations:

• You're subject to their terms and policies
• We're not responsible for their services
• You can disconnect them anytime

9. Fees

Some Services are free and others require payment.

For paid Services:

• Prices and billing terms are shown before purchase
• We will not charge you without authorization
• Subscriptions renew automatically until you cancel them through the payment provider used for purchase
• Canceling a subscription stops future renewals but does not reverse the current billing period

Class Credits and Bookings

Ask Nomi may sell recurring class-credit subscriptions and one-time access to a class. The price, number of credits, renewal period, and credit cost of a class are shown before purchase.

• Subscription credits may be used across eligible classes and expire when the subscription renews. Unused subscription credits do not roll over.
• When you buy a subscription from a class program, we may automatically book upcoming classes in that program while you have enough credits and space is available.
• You may cancel an eligible class booking until 24 hours before its scheduled start. The credits used for that booking will return to your balance.
• Bookings cannot be canceled within 24 hours of the scheduled start, and their credits will not be returned.
• If Ask Nomi cancels a class, we will return the credits used for that booking. If the original credits can no longer be returned, we may issue replacement cancellation credits.
• One-time class purchases apply to the class selected at purchase unless stated otherwise.

Purchases made through Apple are also governed by Apple's payment, cancellation, and refund terms. Purchases made on the web are processed by Stripe and are also subject to Stripe's applicable terms.

10. Changes

We may change our Services or these Terms at any time.

For significant changes:

• We'll notify you by email or in-app
• Continued use means you accept the changes
• You can delete your account if you disagree

11. Termination

You can stop using our Services anytime by deleting your account.

We can suspend or terminate your account if:

• You violate these Terms
• You engage in harmful behavior
• Required by law
• We discontinue the Services

After termination:

• Your data will be deleted per our Privacy Policy
• You lose access to your account immediately

12. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS."

We make no promises about:

• Availability or reliability
• Accuracy of information
• Freedom from errors or bugs
• Meeting your specific needs

We are not liable for:

• Health outcomes or medical decisions
• Data loss or service interruptions
• Actions of other users
• Third-party services

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not responsible for any damages including:

• Lost profits or data
• Health issues or medical outcomes
• Service disruptions
• Any indirect or consequential damages

Our total liability to you is limited to $100 USD or the amount you paid us in the last 12 months, whichever is greater.

14. General Terms

Governing Law

These Terms are governed by the laws of Delaware, USA.

Entire Agreement

These Terms and our Privacy Policy make up the complete agreement between us.

Severability

If any part of these Terms is found invalid, the rest remains in effect.

No Waiver

Our failure to enforce any right doesn't waive that right.

Assignment

You can't transfer these Terms. We can transfer them to affiliates or in a business sale.
